Article 1261

If the consignation having been made, the creditor should authorize the debtor to withdraw the same, he shall lose every preference which he may have over the thing. The co-debtors, guarantors, and sureties shall be released.

Kapag pagtitiwala  ang napagkasunduan ang nagpapautang ang may karapatang bumawi sa nangutang, maaaring mawala sa kanya ang karapatan sa anumang kagustuhan niya sa bagay na ito. Ang kanyang mga kasamahang nagpapautang, mga gumagarantiya, at mga tagapanagot ay magiging malaya.

Kristia owes Bryan P1M with Janine as guarantor. On due date, Kristia offered payment but Bryan refused. Kristia made consignation and withdrew deposit after securing Bryan’s consent.

If Kristia and Janine are solidarily liable to Bryan, Janine may only be released from solidary liability but is still liable to Bryan for 500,000.00 pesos as her share in the obligation.
